GHOTI INDUSTRIES TERMS AND CONDITIONS

Payment terms

• Payment for the invoice total must be received within 7 working days of the invoice date, or the purchase will be voided.
• All payments are to be made by direct deposit, personal cheque, or Bank cheque (banking details can be forwarded upon request).
• Credit Card facilities are not available at this time
• Purchases will be sent within 10 working days of payment being received. With regards to cheques, this is 10 working days of the cheque clearing.

Cancellation

Orders may be cancelled at any point before the payment has been made.

Returns

• I want you to be 100% happy with your Ghoti Industries purchase! But I accept no liability for wrong choice.
• Any returns must first be cleared by email and agreed to by us beforehand, and the goods must be received at ghoti industries before we will send out a replacement. If we receive goods back that have not previously been cleared for return, you will regrettably lose your payment.
• If clothing doesn't fit I will exchange it where possible for another size of the same item with no fee, within 30 days, upon receipt of the clothing; unworn, tags still attached. If this is not feasible you will receive store credit.
• If there is anything wrong with the item (defective, wrong) I will exchange your purchase where possible for an identical item. Where this is not possible I will refund your purchase with store credit upon receipt of the goods within 30 days; unworn, tags still attached.
• I will do my best to package and ship your purchase with the highest care. If the product is in less than perfect condition on receipt, however, please contact me to organise a replacement at our cost within 30 days, upon receipt of the goods; unworn, tags still attached. If this is not feasible you will receive store credit.
• I cannot exchange one product for a different item due to incorrect choice, or if there is evidence of the item being worn.

Non-delivery

We accept no liability for non-delivery of orders if the address supplied to us was incorrect. If the address was correct, the order has not been received after a reasonable amount of time, and enquiries to the relevant delivery agency have been unsuccessful in locating the package, we will where possible send a second order. If both the original and the second order arrive, you are obliged to return the latest-arriving order in the condition in which you received it.

Intellectual property

We take intellectual property rights seriously, and work hard to protect not only our own intellectual property rights, but also the intellectual property and similar rights of artists and others. If you believe that your copyright-protected work has been copied and posted on the Site constituting copyright infringement, you may provide our Internet Administrator with:

1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest
2. a description of the copyrighted work that you claim has been infringed
3. a description of where the material that you claim is infringing is located on the Site
4. your address, telephone number, and e-mail address
5. a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
6. a statement by you that the above information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.

Limited Liability

This Site and all Content available on this Site are provided on an "as is" basis without warranties of any kind, either express or implied, including without limitation warranties of accuracy, warranties of title or implied warranties of merchantability or fitness for a particular purpose. You acknowledge by your use of this Site that your use of this Site is at your sole risk, that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of this Site.

Under no circumstances, including but not limited to negligence, shall Ghoti Industries be liable for any or consequential or other damages that result from the use of, or the inability to use, this Site, even if Ghoti Industries or a Ghoti Industries representative has been advised of the possibility of such damages (the foregoing being subject to any contrary provisions of applicable law). Ghoti Industries expressly disclaims any liability in connection with your use of any Content derived from the Site.
